FCC Suspends, Investigates NECA Changes to Special Access Rates

The FCC has suspended for one day and set for investigation the National Exchange Carrier Association’s (NECA) revisions to its special access rates contained in its Tariff F.C.C. No. 5.  On August 24, 2012, NECA updated its existing tariff by filing Transmittal No. 1358 to increase special access rates to become effective on September 8, 2012.  Thereafter, AT&T filed a petition to suspend and investigate the increased special access rates because it argues that NECA has not provided an adequate justification for the proposed rate increases.  The FCC Wireline Competition Bureau’s Pricing Policy Division issued the suspension and investigation Order, which states that NECA’s tariff revisions raise legal issues and further investigation is required.
